OH
Ohio
Ohio sets the sale age at 21, requires age verification for internet and remote sales, taxes vapor products by volume, and licenses retailers. Some cities ban flavored tobacco, and the Ohio Supreme Court is deciding whether they can.
Ordering online: Ohio allows internet and remote sales only when the seller verifies age. Carriers may not deliver vapor products to unauthorized persons, and packages must be labeled. Many national retailers ship to Ohio under the federal PACT Act (adult signature on delivery).
NY
New York
New York bans the sale of flavored nicotine vapor products, restricts shipping nicotine vapor products to consumers, prohibits discounts, and taxes vapor products at 20% of the retail price.
Ordering online: Vapor product dealers may not ship nicotine vapor products to unauthorized persons in New York, and carriers may not knowingly deliver them. In practice, most online retailers do not ship nicotine vape products to New York consumers.
NJ
New Jersey
New Jersey prohibits discounted sales of vapor products, restricts flavored vapor products, limits bottled e-liquid sales to licensed specialty vapor businesses, and taxes liquid nicotine.
Ordering online: Many national online retailers list New Jersey as a state they do not ship flavored vape products to. Check the retailer’s own shipping policy and New Jersey law before ordering.
PA
Pennsylvania
Pennsylvania treats e-cigarettes as tobacco products, taxes them at 40% of the purchase price charged to the retailer, and requires a retail license. The PHLC snapshot lists no statewide flavor ban.
Ordering online: Online retailers that ship to Pennsylvania must still follow the federal PACT Act (age verification and adult signature on delivery). Check the retailer’s shipping policy.
CT
Connecticut
Connecticut requires ENDS dealers to register, requires age-21 signature delivery for direct-to-consumer shipments, and taxes e-cigarette products by volume or wholesale price.
Ordering online: Registered dealers shipping to Connecticut consumers must label packages and obtain the signature of a person 21 or older, who shows valid ID, at delivery.
Federal rules in every state
Only e-cigarettes with an FDA marketing authorization may be lawfully sold in the United States. As of FDA’s August 28, 2026 update, that is 48 products from five manufacturers.
