Is Geek Bar FDA authorized? What FDA records show

Short answer: no. No Geek Bar product appears on the FDA’s list of authorized e-cigarettes, and the FDA has named Geek Bar in several enforcement actions.

The short answer

  • The FDA’s list of authorized e-cigarettes, current as of August 28, 2026, has 48 products from five manufacturers: Glas, JUUL, Logic, NJOY and R.J. Reynolds Vapor Company (Vuse). No Geek Bar product is on it.
  • The FDA says the products on that list are “the only e-cigarettes that may be lawfully sold in the United States.”
  • The FDA has named Geek Bar products in warning letters to retailers and in a 2024 import seizure (details below).

“Authorized” vs. “approved”

The FDA doesn’t “approve” e-cigarettes. To legally market a new tobacco product, a company must receive a written marketing order from the FDA. So the accurate question is whether a product is FDA authorized. The FDA says authorization “does not mean these products are safe, nor are they ‘FDA approved.’”

What the FDA has said and done about Geek Bar

  • August 1, 2024: the FDA issued warning letters to five online retailers for selling unauthorized e-cigarettes, naming Geek Bar, Lost Mary and Bang products.
  • October 22, 2024: the FDA and U.S. Customs and Border Protection announced the seizure of about 3 million units of unauthorized e-cigarettes, with an estimated retail value of $76 million. The FDA said the shipments originated in China and included “various brands of illegal e-cigarettes, including Geek Bar and others.”
  • December 5, 2024: the FDA warned 115 brick-and-mortar retailers for selling unauthorized e-cigarettes, including Geek Bar Pulse, Geek Bar Skyview, Geek Bar Platinum and Elf Bar. In that notice the FDA cited the 2024 National Youth Tobacco Survey: 5.8% of current youth e-cigarette users reported using Geek Bar products.
  • January 3, 2025: the FDA updated import alerts 98-06 and 98-07. The e-cigarette alert (98-07) reinforces that any unauthorized e-cigarette imported into the United States may be detained without physical examination and refused admission.

Does a pending application make it legal?

No. The FDA says a pending application “does not create a legal safe harbor to sell that product.” As of August 2026, the FDA reports it has issued more than 800 warning letters to firms over new tobacco products sold without marketing authorization.

What about state law?

State rules can be stricter than federal law. New York and New Jersey, for example, prohibit the sale of flavored vapor products (N.Y. How to re-check this yourself

  1. Open the FDA’s authorized e-cigarettes list. The FDA says it intends to add new products the day an e-cigarette is authorized.
  2. Look for the exact brand, device, flavor and nicotine strength. If a product isn’t on the list, it isn’t among the products the FDA identifies as authorized.
  3. For the full record, search the FDA’s Searchable Tobacco Products Database.
